Terms of Service

Welcome to No Cringe. These Terms of Service ("Terms") govern your use of the No Cringe mobile application ("App") operated by No Cringe ("we", "our", or "us"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use No Cringe. By using the App, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the App under any applicable law.
• You have not been previously banned or removed from the App.

We reserve the right to request proof of age at any time and to terminate accounts of users who are found to be under 18.

2. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You may not create more than one account per person.
• You may not use another person's account without permission.

3. User Conduct

By using No Cringe, you agree NOT to:

• Post false, misleading, or deceptive profile information.
• Harass, bully, stalk, intimidate, or threaten any other user.
• Send unsolicited commercial messages or spam.
• Post or share content that is obscene, pornographic, violent, or promotes illegal activities.
• Impersonate any person or entity.
• Use the App for any unlawful purpose.
• Solicit money or financial information from other users.
• Upload viruses, malware, or other harmful code.
• Attempt to access other users' accounts or private data.
• Use automated systems (bots, scrapers) to access the App.
• Discriminate against or demean any individual or group.
• Share or request explicit content from minors, or engage in any behavior that sexualizes or exploits minors in any way.

4. Content

4.1 Your Content

You retain ownership of the content you post on No Cringe (photos, text, messages). By posting content, you grant No Cringe a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and providing the App.

4.2 Content Standards

All content must comply with these Terms. We reserve the right to remove content that violates these Terms without prior notice. This includes but is not limited to:

• Nudity or sexually explicit content.
• Content depicting violence or harm.
• Hate speech or content promoting discrimination.
• Content involving minors in any inappropriate context.
• Copyrighted material used without authorization.

4.3 Reporting

If you encounter content or behavior that violates these Terms, please report it through the App or contact us at [email protected].

The App includes features powered by artificial intelligence and similar technologies. These features may take part in creating, generating, improving, suggesting, or moderating content and communications within the App, and some content you encounter in the App may be produced or enhanced with the help of such technologies. To ensure the quality of the Service, communications within the App may also be reviewed by automated tools for quality, safety, and compliance with these Terms.

5. Subscriptions, Gems, and Payments

5.1 No Cringe Plus

No Cringe offers optional premium subscriptions ("No Cringe Plus") with additional features. Subscriptions are billed through Google Play Store or Apple App Store.

5.2 Billing

• Subscription fees are charged at the beginning of each billing period (monthly or yearly).
• Subscriptions automatically renew unless canceled before the end of the current billing period.
• Prices are displayed in the App and may vary by region.

5.3 Cancellation and Refunds

• You may cancel your subscription at any time through Google Play Store or Apple App Store settings.
• Cancellation takes effect at the end of the current billing period.
• Refund requests are handled by Google Play or Apple App Store in accordance with their respective refund policies.
• We do not provide refunds directly.

5.4 Gems (Virtual Currency)

The App offers "Gems", a virtual currency purchased as consumable in-app products through the Google Play Store or Apple App Store. Gems are used to unlock certain features and content within the App, such as viewing photos received in chat, sending Superlikes, or boosting your profile. The features that require Gems, and the number of Gems each one costs, are shown in the App and may change over time.

• No monetary value. Gems are not money, not a deposit, not an account balance, and not legal tender. They have no value outside the App. Purchasing Gems grants you a limited, personal, non-transferable, revocable licence to use them within the App; you do not own them.
• No cash-out or transfer. Gems cannot be exchanged, redeemed, or converted into money or anything of value outside the App, and cannot be sold, transferred, gifted, or inherited. Gems belong to the account that purchased them and cannot be moved to another account.
• No expiry. Gems do not expire while your account remains active. If we ever introduce an expiry period, we will notify you at least 30 days in advance.
• Loss on termination. If you delete your account, or if we suspend or terminate it in accordance with these Terms, any unused Gems are forfeited without compensation.
• Changes to prices and packs. We may change the price of Gem packs, the number of Gems in a pack, and the Gem cost of any feature at any time. Changes apply going forward only and do not reduce the number of Gems already credited to your account.
• Promotional Gems. We may credit Gems free of charge as part of a promotion. Promotional Gems may be subject to additional conditions and may be withdrawn at any time.
• No guaranteed outcome. Spending Gems unlocks a feature or piece of content. It does not guarantee a reply, a Connection, or any other result.
• Refunds. Purchases of Gems are processed by Google Play or the Apple App Store, and refund requests are handled by them under their respective policies. We do not process refunds directly. This does not affect your statutory rights, including those set out in section 5.5.

5.5 Right of Withdrawal (EU/EEA Consumers)

If you are a consumer resident in the European Union or the European Economic Area, you generally have the right to withdraw from a purchase of digital content within 14 days without giving a reason.

• By purchasing Gems, you expressly request that we supply them immediately, and you acknowledge that you lose your right of withdrawal in respect of any Gems once you have spent them.
• Gems that remain unspent may still be withdrawn from within 14 days of purchase. To do so, contact us at [email protected] before spending them.
• The same applies to a subscription: if you ask us to start providing No Cringe Plus immediately and you then use it, your right of withdrawal ends once the service has been fully performed.

6. Safety and Interactions

No Cringe is a platform for conversations and social discovery. However:

• We do not conduct criminal background checks on users.
• We do not verify the identity, background, or statements of users, and we cannot guarantee that any profile is operated personally by the person it depicts.
• You are solely responsible for your interactions with other users.
• The Service is provided for online communication. We are not responsible for anything that occurs outside the App, including in-person meetings and any related arrangements or expenses.
• Exercise caution when sharing personal information. If you choose to meet someone in person, we strongly recommend meeting in a public place.

Certain profiles in the App may be marked as "Featured" or carry a similar icon. Featured profiles are made available for entertainment and communication within the App; our partners and automated technologies may take part in their creation and operation at any time. Paid features of the App apply to communication with Featured profiles in the same way as to any other communication, and this Section applies to Featured profiles in full.

7. Intellectual Property

The App, including its design, features, functionality, code, and content (excluding user-generated content), is owned by No Cringe and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Termination

• You may delete your account at any time through the App settings or by contacting us.
• We may suspend or terminate your account at any time, with or without cause, including for violations of these Terms.
• Upon termination, your right to use the App ceases immediately.
• Provisions that by their nature should survive termination will survive (including limitations of liability, indemnification, and dispute resolution).

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free.
• Any Sparks or Connections will result in any particular outcome.
• User-provided information is accurate or truthful.
• Any profile is operated personally by the individual it depicts.

10. Service Providers

To provide the Service, we engage third-party contractors and service providers. Depending on their role, such providers may assist with creating and managing content and profiles that appear in the App, help operate accounts, or have access to communications within the App — for example for translation, moderation, quality assurance, or support purposes. Service providers act as independent contractors and are not our employees or agents; we are not responsible for their acts or omissions, and we are under no obligation to disclose their identity or contact details.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NO CRINGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to indemnify, defend, and hold harmless No Cringe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which No Cringe operates, without regard to its conflict of law provisions.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or by other means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
