Terms of Service

Welcome to Lyly. These Terms of Service ("Terms") govern your use of the Lyly mobile application ("App") operated by Lyly ("we", "our", or "us"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Lyly. By using the App, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the App under any applicable law.
• You have not been previously banned or removed from the App.

We reserve the right to request proof of age at any time and to terminate accounts of users who are found to be under 18.

2. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You may not create more than one account per person.
• You may not use another person's account without permission.

3. User Conduct

By using Lyly, you agree NOT to:

• Post false, misleading, or deceptive profile information.
• Harass, bully, stalk, intimidate, or threaten any other user.
• Send unsolicited commercial messages or spam.
• Post or share content that is obscene, pornographic, violent, or promotes illegal activities.
• Impersonate any person or entity.
• Use the App for any unlawful purpose.
• Solicit money or financial information from other users.
• Upload viruses, malware, or other harmful code.
• Attempt to access other users' accounts or private data.
• Use automated systems (bots, scrapers) to access the App.
• Discriminate against or demean any individual or group.
• Share or request explicit content from minors, or engage in any behavior that sexualizes or exploits minors in any way.

4. Content

4.1 Your Content

You retain ownership of the content you post on Lyly (photos, text, messages). By posting content, you grant Lyly a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and providing the App.

4.2 Content Standards

All content must comply with these Terms. We reserve the right to remove content that violates these Terms without prior notice. This includes but is not limited to:

• Nudity or sexually explicit content.
• Content depicting violence or harm.
• Hate speech or content promoting discrimination.
• Content involving minors in any inappropriate context.
• Copyrighted material used without authorization.

4.3 Reporting

If you encounter content or behavior that violates these Terms, please report it through the App or contact us at [email protected].

5. Subscriptions and Payments

5.1 Lyly Plus

Lyly offers optional premium subscriptions ("Lyly Plus") with additional features. Subscriptions are billed through Google Play Store or Apple App Store.

5.2 Billing

• Subscription fees are charged at the beginning of each billing period (monthly or yearly).
• Subscriptions automatically renew unless canceled before the end of the current billing period.
• Prices are displayed in the App and may vary by region.

5.3 Cancellation and Refunds

• You may cancel your subscription at any time through Google Play Store or Apple App Store settings.
• Cancellation takes effect at the end of the current billing period.
• Refund requests are handled by Google Play or Apple App Store in accordance with their respective refund policies.
• We do not provide refunds directly.

6. Safety and Interactions

Lyly is a platform for connecting people. However:

• We do not conduct criminal background checks on users.
• We do not verify the identity, background, or statements of users.
• You are solely responsible for your interactions with other users.
• Exercise caution when sharing personal information or meeting in person.
• We strongly recommend meeting in public places for first meetings.

7. Intellectual Property

The App, including its design, features, functionality, code, and content (excluding user-generated content), is owned by Lyly and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Termination

• You may delete your account at any time through the App settings or by contacting us.
• We may suspend or terminate your account at any time, with or without cause, including for violations of these Terms.
• Upon termination, your right to use the App ceases immediately.
• Provisions that by their nature should survive termination will survive (including limitations of liability, indemnification, and dispute resolution).

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free.
• Any matches or connections will result in any particular outcome.
• User-provided information is accurate or truthful.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LYLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lyly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lyly operates, without regard to its conflict of law provisions.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or by other means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
